March 2009: Federal Court Certifies Nationwide Class Action Against UPS

 

 

On March 18, 2009, the Northern District of California certified a nation-wide class of delivery drivers in LaBrie v. UPS Supply Chain Solutions, Inc., No. 08-cv-3182, a case challenging the misclassification of UPS Supply Chain Solutions drivers as "independent contractors." Through its sham "independent contractor" arrangement, UPS has deprived its drivers across the country of the minimum wages and overtime pay they are entitled to by law, while reaping financial rewards for itself. The court's March 18 order expands the case to cover not only the five brave workers who brought suit to vindicate their rights, but also every current or former driver who has worked for UPS Supply Chain Solutions in the past four years who opts into this litigation.
