May 2007: Arbitrator Rejects San Francisco's Practice of Unpaid Administrative Leave

In a 115 page decision, Arbitrator Luella Nelson found, among other holdings, that the practice of the City and County of San Francisco of placing employees on unpaid administrative leave violated the Skelly provisions found in the contract between the City and International Federation of Professional and Technical Engineers, Local 21. This decision was the culmination of a multi-year fight over a practice that the City has followed with respect to employees in many different City bargaining units represented by multiple unions. The City first refused to arbitrate the issue altogether and was ultimately ordered to arbitrate by order of the San Francisco Superior Court.
