David Pogrel

Dave Pogrel has exclusively represented workers in employment litigation and counseling since graduating from UC Berkeley School of Law in 1999. At Leonard Carder, Dave represents workers in class action and individual employment cases, with particular emphasis on wage and hour (including overtime, minimum wage, meal and rest periods, expense reimbursements), discrimination, retaliation and whistle-blower law.   He has served as class counsel in dozens of wage and hour class and collective actions, representing a diverse array of employees that include delivery drivers, salespeople, flooring installers and other construction workers, tech workers, security guards, garbage collectors, bank employees and airport shuttle drivers.  Many of his cases involve workers who have been misclassified as “Independent Contractors” by unscrupulous employers seeking to circumvent their employee obligations.

Prior to joining the firm, he was a partner in a plaintiffs’ firm in Walnut Creek. Dave started his legal career as a Staff Attorney at the Legal Aid Society Employment Law Center, spending over five years supervising a direct legal services program that represented low-wage workers with wage and hour claims and unemployment insurance appeals.
