August 2006: Third in Trio of Victories for AC-Transit Drivers
 

 

  On behalf of ATU Local 192, Leonard Carder secured three significant victories for AC Transit District bus drivers during the summer of 2006. First, in settlement of a class action lawsuit, the District agreed to pay drivers overtime when they are required to spend time outside of their shift preparing and securing their buses before and after a run and that time exceeds 8 hours per day or 40 hours per week. This class-wide settlement both brings the District in compliance with the law going forward and provides $1 million in back pay to the drivers, plus attorney fees.

Next, in a separate settlement resolving a threatened lawsuit, the District agreed to implement a strong policy allowing paratransit drivers to take meal and rest breaks, and also agreed to pay all paratransit drivers back pay for missed meal and rest breaks back to July 2004.

Finally, Leonard Carder arbitrated a dispute with the District and successfully asserted that when a driver's run ends at a different point than it starts, the District must pay the driver travel time to get back to the start point of the run. The Arbitrator’s award sustains this position, ordering the District to begin paying such travel time and to pay back wages for such time back to October 2003.
