October 2005: Judge Grants Injunctive Relief Against FedEx But Legal Fight Continues in California and Nationwide

 

  On October 7, 2005, Judge Howard J. Schwab issued a decision requiring FedEx Ground to stop misclassifying its single work area drivers as independent contractors, for so long as the Company continues to use substantially the same business model as at present. In addition to protecting drivers’ right to reimbursement for the substantial costs associated with driving their pickup and delivery routes, the court’s injunction gives drivers the benefit of a wide array of laws and regulations that have been put into place to protect employees. As reported in an article in the Sacramento Bee, FedEx has indicated its intent to appeal. Moreover, 31 new cases have been filed in 24 states against FedEx involving the independent contractor issue. Those cases that are in Federal Court have been consolidated for discovery purposes before U.S. District Judge Robert Miller in South Bend, Indiana.  More
